Premarital Agreements

We represent clients with Premarital Agreements. Premarital Agreements are also known as Prenuptial Agreements.  Premarital Agreements are signed prior to a marriage or civil union and are between individuals who intend to marry.

A Premarital Agreement can decrease future conflicts upon a divorce or legal separation or upon the death of one of the parties.  A Premarital Agreement can assist you in deciding, in advance, what is marital property and what is separate property in the event of a divorce or legal separation.  You may also consider how marital property would be divided and whether or not maintenance or attorneys’ fees would be considered.  We can assist you in considering whether to use a  Premarital Agreement and discussing, negotiating, and drafting your Premarital Agreement.

Colorado adopted the Uniform Premarital and Marital Agreements Act which took effect on July 1, 2014.   We can advise you of the current law under the Act and the enforceability of waivers of maintenance and attorneys’ fees in Premarital Agreements in the event of a divorce or legal separation.

We can assist you in litigation and enforcement of a previously executed Premarital agreement.  We have experience representing clients who are trying to enforce a prior Premarital Agreement and clients who are trying to show that a prior Premarital Agreement is unenforceable.

Post-Marital Agreements

We represent clients with Post-Marital Agreements.  Post-Marital Agreements are also called Antenuptial or Post-Nuptial Agreements.  Post-Marital Agreements are signed after a wedding ceremony or civil union by spouses who intend to remain married.

Even after parties are married or joined by a civil union, a Post-Marital Agreement can define the rights and obligations of each party in the event of a divorce or legal separation. We can assist you in discussing, negotiating, and drafting your Post-Marital Agreement. We can also assist you in litigation and enforcement of a previously executed Post-Marital Agreement.
